Terms of Service

1. Who we are

Enchanted Fitness is a fitness and nutrition service operated by Enchanted Rose Enterprises LLC, doing business as "Enchanted Fitness" ("we," "us," "our," "the Service"), with a mailing address at PO Box 205, Morristown, NY 13664, United States. Enchanted Rose Enterprises LLC is the seller of every subscription and purchase on the Service and is the name on your receipts. By creating an account or using the Service, you ("you," the "user") agree to these Terms of Service.

2. Age requirement

The Service is for adults only. You must be eighteen (18) years of age or older to create an account, pay any fee, or use any feature of the Service. We do not knowingly collect information from anyone under 18. By registering you affirm that you meet this requirement. If we become aware that an underage user has created an account, we will terminate the account and delete associated personal data.

3. Nature of the Service

Enchanted Fitness provides fitness training programs, nutritional guidance, and AI-assisted plans. The Service is operated by Enchanted Rose Enterprises LLC. Weekly workouts, meal plans, and macro targets are generated, in whole or in part, by artificial intelligence from the programs and rules the Service uses, and are not individually written by a person. Messages you send through the Service are read and answered by the support staff of Enchanted Rose Enterprises LLC. We do not provide psychological, medical, or therapeutic services.

Not medical advice. Content on the Service is general fitness and nutrition information, not medical advice. Consult a licensed physician before beginning any exercise or dietary program, particularly if you have any medical condition, are pregnant or nursing, take medication, have an eating disorder history, or are recovering from injury. You use the Service at your own risk.

Private beta. Some features are still being tested. Beta access may change, pause, or end while we improve the Service. If a beta feature fails, we will try to fix it, but beta access does not guarantee uninterrupted availability.

4. Accounts

You are responsible for the security of your password, for all activity under your account, and for the accuracy of information you provide. We may suspend or terminate accounts that violate these Terms, submit false information, attempt to circumvent payment, or harass other users or staff.

5. Subscriptions, payment, and fees

The paid plan (Plus) is a subscription billed in advance. It offers monthly and annual billing. Subscriptions auto-renew until canceled.

How you are billed. On the website, subscriptions and one-time purchases are processed by our payment processor, Stripe. In the Enchanted Fitness app for iPhone and iPad, purchases are made through Apple's App Store and are billed to your Apple Account. In the Enchanted Fitness app for Android, purchases are made through Google Play and are billed to your Google Account. A purchase made through the App Store or Google Play is also subject to Apple's or Google's own terms for that store. Prices shown on the pricing page are current for the website. Prices in the app are shown by the App Store or Google Play, may be in your local currency, and may differ from website prices. We may change prices with prior notice, effective on a future renewal unless you choose a new plan sooner.

Free trial. Plus bought on the website may start with a 14-day free trial. Each person may have one free trial. A trial is not offered to anyone who has had a paid subscription before. You add a payment card when the trial starts, and it is not charged during the trial. When the trial ends, the card is charged the monthly or annual price you chose, and the subscription then auto-renews until canceled. We email you a reminder at least 7 days before the trial ends, and again about 2 days before. If you cancel during the trial, you are not charged, and paid access ends when the trial ends. Free trials are not currently offered for purchases made through the App Store or Google Play.

Cancellation. A subscription bought on the website can be canceled at any time from Settings on the website. A subscription bought through the App Store must be canceled in your Apple Account's subscription settings (on an iPhone, in Settings under Subscriptions). A subscription bought through Google Play must be canceled in Google Play (in the Play Store, under Payments and subscriptions). We are not able to cancel an App Store or Google Play subscription for you, and deleting the app or your account does not cancel it. Cancellation stops the next renewal. Your paid access continues until the end of the period you have paid for, including the full year on an annual plan. When paid access ends, the Service reverts to the free tier.

Refunds. Subscription fees already paid for a billing period are non-refundable. For purchases made on the website, we may issue refunds at our sole discretion for technical failures or billing errors. Refunds for purchases made through the App Store are requested from Apple and are decided by Apple under its refund policies. Refunds for purchases made through Google Play are requested from Google and are handled under Google Play's refund policies.

Extras and one-time purchases. Optional one-time purchases, if available in the Service, are charged separately: through Stripe on the website, or through the App Store or Google Play in the app. Some purchases, such as live sessions, are available on the website only. Enchanted Rose Enterprises LLC is the seller of every one-time purchase. Unless a purchase page says otherwise, one-time purchases are non-refundable once delivered, subject to the refund policies of Apple or Google for purchases made through their stores.

Failed payments. If a subscription payment fails, Stripe, Apple, or Google retries the charge on its standard schedule. Apple and Google may keep your access open for a short grace period while they retry. After repeated failures the subscription is canceled automatically.

6. Acceptable use

You agree not to:

Use the Service for any unlawful, harmful, fraudulent, or infringing purpose.
Copy, distribute, resell, or sublicense any part of the Service, including training content, workouts, meal plans, branding, or AI-generated output, for commercial purposes without written permission.
Scrape, reverse-engineer, or otherwise attempt to extract training data.
Harass, threaten, or otherwise abuse staff or other users.
Attempt to access another user's account, private data, or messages.
Upload or transmit content that is illegal, defamatory, or violates another person's rights.

7. Intellectual property

The Service, its branding (including "Enchanted Fitness" and related marks), content, templates, programs, photographs, AI model outputs, and software are owned by us or our licensors and are protected by copyright, trademark, and other laws. You receive a limited, revocable, non-exclusive, non-transferable license to use the Service for your personal, non-commercial fitness use while your account is active.

Content you upload (journal entries, photos, messages) remains yours; by uploading you grant us a license to store, display, and process it solely for operating the Service.

8. AI-generated content

Parts of the Service use AI (including models from third-party providers such as Anthropic) to generate workouts, meal plans, message responses, and other output. AI output may be incorrect, incomplete, or inappropriate. Do not rely on AI output for medical, legal, financial, or safety-critical decisions. We review AI output at our discretion but do not guarantee that every piece is reviewed.

You are responsible for checking that exercises, meals, and targets fit your body before acting on them. Stop any movement or plan that causes pain, dizziness, allergic symptoms, disordered-eating behavior, or other unsafe effects.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT CONTENT WILL BE ACCURATE OR RELIABLE.

You assume all risk of physical injury, illness, or other harm arising from your use of the workouts, meals, or protocols suggested on the Service.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL CUMULATIVE LIABILITY WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100) OR (B) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

11. Indemnification

You agree to defend, indemnify, and hold us harmless from any claims, damages, or costs arising out of your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

12. Termination

You may delete your account at any time via Settings → Delete my account. We may suspend or terminate your access for any violation of these Terms, for non-payment, or at our discretion for conduct we reasonably believe is harmful to the Service or other users. Sections 5 (non-refundability), 7, 9, 10, 11, and 13 survive termination.

13. Governing law

These Terms are governed by the laws of the State of New York, United States, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or the Service will be resolved exclusively in the state or federal courts located in that jurisdiction, and you consent to personal jurisdiction there.

14. Changes to these Terms

We may update these Terms from time to time. Material changes will be noted by updating the "Last updated" date at the top; continued use after that date constitutes acceptance.
