Terms of Service

1. Who we are

Enchanted Fitness is a fitness coaching service operated as a sole proprietorship doing business as "Enchanted Fitness" ("we," "us," "our," "the Service"), with a mailing address at PO Box 205, Morristown, NY 13664, United States. By creating an account or using the Service, you ("you," the "user") agree to these Terms of Service.

2. Age requirement

The Service is for adults only. You must be eighteen (18) years of age or older to create an account, submit an application, pay any fee, or use any feature of the Service. We do not knowingly collect information from anyone under 18. By registering you affirm that you meet this requirement. If we become aware that an underage user has created an account, we will terminate the account and delete associated personal data.

3. Nature of the Service

Enchanted Fitness provides fitness training programs, nutritional guidance, AI-assisted coaching, and a stylized character-driven user experience. The coach persona (The Enchantrix) is a fictional brand voice that delivers workout, nutrition, and motivational content in a confident, direct style. Coaching output, macros, workouts, and messages may be generated, in whole or in part, by artificial intelligence. The brand voice is purely aesthetic; we do not provide psychological, medical, sexual, or therapeutic services, and the Service is not lifestyle counseling of any kind.

Not medical advice. Content on the Service is general fitness and nutrition information, not medical advice. Consult a licensed physician before beginning any exercise or dietary program, particularly if you have any medical condition, are pregnant or nursing, take medication, have an eating disorder history, or are recovering from injury. You use the Service at your own risk.

4. Accounts

You are responsible for the security of your password, for all activity under your account, and for the accuracy of information you provide. We may suspend or terminate accounts that violate these Terms, submit false information, attempt to circumvent payment, or harass other users or staff.

5. Subscriptions, payment, and fees

Paid tiers (Pack, Her Voice, Chosen, Prized) are monthly subscriptions billed in advance by our payment processor, Stripe. Prices shown on the pricing page are current; we may change them with prior notice, effective on your next renewal. Subscriptions auto-renew until canceled.

Cancellation. You can cancel a subscription anytime via the billing portal linked from your Settings page. Cancellation takes effect at the end of the current billing period by default (or immediately when you use the in-app cancel flow), at which point the Service reverts to the free tier.

Application tribute. Submitting an application for the Chosen or Prized tier requires a one-time $36 tribute fee. This fee is non-refundable, regardless of outcome: paid whether or not your application is approved. If approved, the $36 is credited toward your first subscription invoice. This policy is explicit at the point of payment.

Refunds. Subscription fees already paid for a billing period are non-refundable. We may issue refunds at our sole discretion for technical failures or billing errors.

Failed payments.If a subscription payment fails, we will retry the charge per our payment processor's standard schedule. After repeated failures the subscription is canceled automatically.

6. Acceptable use

You agree not to:

Use the Service for any unlawful, harmful, fraudulent, or infringing purpose.
Copy, distribute, resell, or sublicense any part of the Service, including coaching content, workouts, meal plans, branding, or AI-generated output, for commercial purposes without written permission.
Scrape, reverse-engineer, or otherwise attempt to extract training data.
Harass, threaten, or otherwise abuse staff or other users.
Attempt to access another user's account, private data, or messages.
Upload or transmit content that is illegal, defamatory, or violates another person's rights.

7. Intellectual property

The Service, its branding (including "Enchanted Fitness," "The Enchantrix," and related marks), content, templates, programs, photographs, AI model outputs, and software are owned by us or our licensors and are protected by copyright, trademark, and other laws. You receive a limited, revocable, non-exclusive, non-transferable license to use the Service for your personal, non-commercial fitness use while your account is active.

Content you upload (journal entries, photos, messages) remains yours; by uploading you grant us a license to store, display, and process it solely for operating the Service.

8. AI-generated content

Parts of the Service use AI (including models from third-party providers such as Anthropic) to generate workouts, meal plans, message responses, and other coaching output. AI output may be incorrect, incomplete, or inappropriate. Do not rely on AI output for medical, legal, financial, or safety-critical decisions. We review AI output at our discretion but do not guarantee that every piece is reviewed.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT CONTENT WILL BE ACCURATE OR RELIABLE.

You assume all risk of physical injury, illness, or other harm arising from your use of the workouts, meals, or protocols suggested on the Service.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL CUMULATIVE LIABILITY WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100) OR (B) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

11. Indemnification

You agree to defend, indemnify, and hold us harmless from any claims, damages, or costs arising out of your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

12. Termination

You may delete your account at any time via Settings → Delete my account. We may suspend or terminate your access for any violation of these Terms, for non-payment, or at our discretion for conduct we reasonably believe is harmful to the Service or other users. Sections 5 (non-refundability), 7, 9, 10, 11, and 13 survive termination.

13. Governing law

These Terms are governed by the laws of the State of New York, United States, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or the Service will be resolved exclusively in the state or federal courts located in that jurisdiction, and you consent to personal jurisdiction there.

14. Changes to these Terms

We may update these Terms from time to time. Material changes will be noted by updating the "Last updated" date at the top; continued use after that date constitutes acceptance.
